By accessing and using OrbitServers' website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

OrbitServers provides VPS (Virtual Private Server) and Bare Metal server hosting services. We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

  • Maintaining the security of your account and password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring that your account information is kept up to date

4. Acceptable Use Policy

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any malicious code, viruses, or harmful data
  • Engage in any form of spam, phishing, or fraudulent activity
  • Interfere with or disrupt the integrity or performance of our services
  • Attempt to gain unauthorized access to our systems or networks
  • Use our services for any illegal or unauthorized purpose

5. Payment Terms

Payment terms include:

  • All fees are due in advance according to your selected billing cycle
  • We accept various payment methods as specified on our website
  • Prices are subject to change with prior notice
  • Refunds are subject to our refund policy as detailed in Section 6
  • Failure to pay may result in service suspension or termination
  • There is no facility for credit withdrawal. Credits however do not expire and can be used at any time in the future

6. Refund Policy

OrbitServers operates on a strict no-refund policy. All sales are final, and we do not provide refunds except under the limited circumstances outlined below.

Limited Refund Eligibility: Refunds may only be considered within 24 hours of service activation, and only if the service fails to meet the advertised specifications or performance standards. This applies to both VPS (Virtual Private Server) and Bare Metal (dedicated server) services.

To be eligible for a refund consideration, the following conditions must be met:

  • The refund request must be submitted within 24 hours of service activation
  • The service must demonstrably fail to meet the advertised specifications (e.g., incorrect CPU, RAM, storage, or network speeds)
  • The service must exhibit performance issues that prevent basic functionality
  • You must provide detailed evidence and allow our technical team to investigate the issue
  • The issue must not be caused by user error, misconfiguration, or violation of our Acceptable Use Policy

Non-Refundable Circumstances: Refunds will not be provided for:

  • Change of mind or no longer needing the service
  • Failure to meet your specific use case requirements
  • Performance issues related to your applications, software, or configurations
  • Violations of our Terms of Service or Acceptable Use Policy
  • Downgrades, upgrades, or plan changes
  • Services that have been used beyond basic testing
  • Any request made after the 24-hour window

All refund requests are subject to review and approval at our sole discretion. If approved, refunds will be processed to the original payment method within 5-10 business days.

Crypto Payment Refunds: Crypto payments can only be refunded to the account credit. Refunds will not be processed back to the original crypto wallet or exchange.

By purchasing our services, you acknowledge and agree to this refund policy.

7. Service Level Agreement (SLA)

We strive to maintain high availability and performance standards. However, we do not guarantee uninterrupted or error-free service. Scheduled maintenance will be communicated in advance when possible. Our SLA details are available upon request.

8. Data Backup and Loss

You are responsible for maintaining backups of your data. While we implement backup systems, we are not responsible for any data loss. We recommend that you regularly backup your data and maintain copies of important information.

9. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, and software, are the exclusive property of OrbitServers and are protected by international copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, OrbitServers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

11. Indemnification

You agree to indemnify and hold harmless OrbitServers, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of our services or violation of these terms.

12. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice, for any reason, including but not limited to:

  • Breach of these Terms and Conditions
  • Non-payment of fees
  • Violation of our Acceptable Use Policy
  • Request by law enforcement or other government agencies

13. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms and Conditions on this page and updating the "Last updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the appropriate courts.
